Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the CardSwapio website, applications, and services (the "Service"), operated by CardSwapio ("CardSwapio," "we," "us," or "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract. You may not use the Service if you are located in, or a resident of, a jurisdiction where use is prohibited by applicable law or by sanctions.

2. The Service

CardSwapio allows users to submit unused gift card codes or cards for resale in exchange for a cash payout delivered through a payment method of your choice. Exchange rates are displayed on the Service and are estimates; the final payable amount is confirmed after verification.

3. Your submissions

By submitting a gift card you represent and warrant that:

• You are the lawful owner of the card or have the rightful authority to sell it.
• The card has not been obtained through fraud, theft, or any unlawful means.
• The card has not been redeemed, partially used beyond what you disclose, or submitted to any other buyer.
• The information you provide (card number, PIN, expiry, balance, ownership) is accurate and complete.

We may request additional verification, including identity documentation, before releasing a payout.

4. Verification and payouts

After you submit a card, we verify the card's balance and validity with the issuer or through our verification partners. If the card is verified, we release the payout to your selected account. Payouts typically settle within the estimated time shown for each method, subject to network availability and verification load. Estimated times are not guaranteed.

5. Prohibited activities

You agree not to:

• Submit gift cards obtained through theft, fraud, chargeback reversal, account takeover, or any unlawful means.
• Submit the same card to multiple buyers or to CardSwapio more than once.
• Create multiple accounts, misrepresent your identity, or circumvent any verification.
• Use the Service for money laundering, terrorist financing, or any activity in violation of sanctions.
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.

6. Fees and pricing

Our payout rate for each brand is displayed on the Service and updates based on market conditions. There are no additional fees beyond the displayed rate unless explicitly stated (e.g. network fees for certain cryptocurrency withdrawals). The rate locked at the time of submission applies to that trade.

7. Rejection, holds, and cancellations

We may reject, hold, reduce, or reverse a payout if the card fails verification, appears fraudulent, has a different balance than declared, is disputed by the issuer, or if your account is flagged for risk review. Details are covered in our Refund & Cancellation Policy.

8. Account suspension and termination

We may suspend or terminate your access to the Service at our discretion, including without notice, for violation of these Terms, suspected fraud, or as required by law. You may stop using the Service at any time.

9. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted availability, specific payout times, or specific exchange rates beyond the rate locked at submission.

10. Limitation of liability

To the maximum extent permitted by law, CardSwapio and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to your use of the Service. Our aggregate liability for any claim is limited to the amount of the specific transaction giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless CardSwapio, its affiliates, officers, and employees from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your submissions, or your use of the Service.

12. Governing law and disputes

These Terms are governed by the laws of the State of Alaska, United States, without regard to conflict-of-law principles. Disputes will be resolved by binding individual arbitration, except that either party may seek injunctive relief in court to protect intellectual property.

13. Changes to these Terms

We may update these Terms at any time. Material changes will be posted on this page and, where appropriate, notified by email. Your continued use of the Service after the effective date constitutes acceptance.
